Independent Consumer Protection Office

Educates, advises, and advocates for consumers of electricity, telecommunications, and services under NTSP. It is administratively consolidated within JRSP, but the law requires independence from regulators and regulated entities. It may represent consumers; it does not decide their complaints.

What it does

  • Explains rights, responsibilities, and procedures to customers in the three sectors. Its educational work includes guidance on presenting and documenting a claim, beyond intervening in cases already filed.Art. 6.42(a) ↗Responsibilities ↗ · Sources consulted:
  • May file complaints and legal proceedings before the three bureaus for customers without other legal representation. It first checks the relevant administrative prerequisites; where customer classes conflict, the statute prioritizes residential customers and small businesses.Art. 6.42(d) ↗ · Sources consulted:
  • Participates in rate proceedings and submits independent recommendations on billing, service quality, planning, and other consumer matters. Advocating a position does not guarantee the regulator will adopt it.Art. 6.42(b)–(h) ↗ · Sources consulted:
  • May conduct studies, comment on proposed laws and regulations, and appear in courts or before bodies with jurisdiction. It has statutory access to records subject to privileged-information exceptions; it does not have unrestricted access to every document.Art. 6.42(h)–(m) ↗Art. 6.42(i)–(m) ↗ · Sources consulted:

In everyday life

A customer does not understand how to dispute an electricity bill. OIPC can explain the prior steps with the company and assess representation before NEPR, checking requirements and whether the customer already has legal representation. The office helps advocate the claim; the competent forum decides the dispute.Arts. 6.27(a), 6.42(d) ↗Art. 6.42(d) ↗NEPR proceedings ↗ · Sources consulted:

How to distinguish it from other institutions

OIPC advocates or represents; NEPR, NET, and NTSP regulate and adjudicate. Its independence is expressly protected even though JRSP facilitates facilities, staffing, and contracting. Administrative integration does not make it a spokesperson for companies or bureau decisions.Arts. 6.40(b)–(c), 6.41(a) ↗ · Sources consulted:

Its name does not make it the office for every consumer dispute. The jurisdiction described here concerns services under the three bureaus. Assistance or representation requires assessing the matter, prior procedural steps, and statutory conflicts of interest.Arts. 6.40(a), 6.42(a), (d) ↗Art. 6.42(d) ↗ · Sources consulted:

Legal basis

Act 57-2014, articles 6.40–6.43, as amended by the 2018 reorganization and later legislation, defines creation, independence, organization, and responsibilities. Former article 6.41 was repealed and other articles renumbered; a pre-2018 description is insufficient to establish the current structure.Arts. 6.40–6.43 y notas de enmienda ↗Art. 6.41 y nota ↗Secs. 69–73 ↗ · Sources consulted:

Leadership & appointments

OIPC Executive Director

The portal identifies Hannia Rivera Díaz as executive director. JRSP handles staffing and professional-services contracting while respecting the office’s autonomy. This review has not separately established the director’s appointment instrument, appointing authority, confirmation, or term; JRSP’s executive-director rule is not automatically applied to OIPC’s director.Executive Director ↗Arts. 6.40(c), 6.41(a) ↗Sec. 8A ↗ · Sources consulted:

Governance & composition

Current articles 6.40–6.43 organize an office with staff and consultants and do not establish a separate governing board. JRSP’s three-member board and the bureaus’ commissions are distinct structures. A repealed structure is not revived, and shared administration does not become an OIPC board.Arts. 6.40–6.43 ↗Art. 6.41 ↗Sec. 8B ↗ · Sources consulted:
