Puerto Rico Health Insurance Administration

Contracts for and monitors government health coverage and services, including Plan Vital. It is a public corporation with its own board: financing and overseeing coverage differ from treating patients or certifying Medicaid eligibility.

What it does

  • Negotiates and contracts with insurers and health-service organizations for medical and hospital coverage; it may also contract directly with providers for specified services. Its role extends beyond issuing plan cards.Art. IV, sec. 2(a)–(c) ↗ · Sources consulted:
  • Monitors contracted insurers’ compliance, including access, quality, and contractual obligations. Oversight of an insurance contract differs from licensing a treatment institution. What is ASES?; organizational chart, note 3 ↗Regulatory Bodies Office ↗ · Sources consulted:
  • Publishes Plan Vital guidance for beneficiaries on insurers, rights, and coverage-related processes. Eligibility assessment is handled by the Health Department’s Medicaid Program.Beneficiaries: eligibility and information ↗Art. VI, sec. 1 ↗ · Sources consulted:
  • Its structure includes clinical affairs, pharmacy, quality, and statistics, as well as compliance and complaints functions. In everyday life

When a person receives an eligibility notice, official guidance directs them to Health’s Medicaid Program. For questions about a Plan Vital insurer or contracted coverage, ASES information helps identify the appropriate process. A medical appointment is arranged with the provider: purchasing insurance and delivering a consultation are different responsibilities.Eligibility; beneficiaries; insurers ↗Art. How to distinguish it from other institutions

Medicaid determines eligibility; ASES negotiates and administers coverage; insurers and providers participate in service delivery. An eligibility decision, a coverage dispute, and a clinical-care concern are different matters.Arts. IV, sec. 2; VI, secs. 1–2 ↗Art. VI, secs. 1–2 ↗Beneficiaries ↗ · Sources consulted:

Seats held by Health, ASSMCA, and other institutions create participation in corporate governance. They do not make those institutions ASES subsidiaries or establish ASES’s administrative attachment to Health.Art. IV, secs. 1, 3–4 ↗Art. IV, secs. 3–4 ↗ · Sources consulted:

Legal basis

Act 72-1993, as amended, art. IV, establishes the corporation, powers, and board; art. V addresses executive leadership and art. VI insurance plans. It must be read with Act 2-2017 art. 16 to account for succession to the seat still described in ASES’s text as the Government Development Bank seat.Arts. IV–VI ↗Art. 16 ↗ · Sources consulted:

Leadership & appointments

ASES executive director

The Board appoints the executive director, who serves at its pleasure. The governor appoints five board members with Senate advice and consent and selects the board chair from its members. Appointing board members is different from directly appointing the executive director. This review does not certify the current executive director.Art. V, secs. 1–3 ↗Art. An absent name does not imply a vacancy. Names from the seed report are not automatically treated as current officeholders.

Governance & composition

The law establishes eleven members: six ex officio and five gubernatorial appointees confirmed by the Senate. Ex officio roles are Health, Treasury, ASSMCA, OGP, Insurance, and the financial seat transferred by Act 2-2017 from GDB to AAFAF or its designee, subject to that Act’s delegation provision. The five appointees represent insurance, two providers—one in primary care—beneficiaries, and the public interest. Ordinary terms are six years, with holdover until a successor is appointed and replacement rules for unfinished terms. The governor selects the chair from the membership. Members, vacancies, and terms are not certified as a complete roster. An expired term is not automatically treated as a vacancy; some laws allow service until a successor qualifies.

ASES’s page lists eleven names but does not supply all appointment, confirmation, and term dates or certify the roster’s currency. GDB–AAFAF legal succession is documented; the current representative’s identity and the roster’s currency require additional records. This profile therefore explains the seats and retains a partially verified board status.Board of Directors ↗Art. 16 ↗ · Sources consulted:
