Office of the Commissioner of Financial Institutions

The state-level regulator of banks and other financial businesses under the laws it administers, including mortgage lending, financing, and securities intermediation. It examines institutions, processes licenses, and investigates possible violations. Insurance falls to OCS; savings and credit cooperatives left OCIF’s jurisdiction when COSSEC was created.

What it does

  • Authorizes and supervises financial activities through licenses, registrations, examinations, and investigations. Its areas distinguish deposit-taking institutions, nondepository businesses, and securities: handling money does not mean every activity follows the same licensing regime.Work areas; licensing and examinations ↗Art. 4(g) ↗ · Sources consulted:
  • Receives and investigates complaints involving rights under the laws it administers. It can issue orders, impose administrative fines, and seek judicial enforcement. A complaint begins an assessment; it does not guarantee that the requested remedy is authorized.Arts. 10(a)(3)–(11), 13 ↗Art. 13 ↗Investigative authority ↗ · Sources consulted:
  • Provides financial education through a division that develops tools and partnerships for people of different ages. Act 2-2023 brought the former Financial Education Institute’s functions into OCIF; education is distinct from deciding an individual complaint.Arts. 3, 7(d)–(e) ↗Art. 7(d)–(e) ↗Art. 7(e) ↗ · Sources consulted:
  • Provides guidance on inactive accounts and abandoned or unclaimed property. Its page explains how to search and then submit information for a return: a search result alone is neither a formal claim nor proof of entitlement to money.Unclaimed-property searches and claims ↗ · Sources consulted:

In everyday life

If a financing company charges a fee you believe violates the rules, identify the institution and gather the relevant contract, account statements, and communications. The official form asks for the facts, the legal provision if known, and the remedy requested. OCIF’s complaint service lets you submit the matter for a jurisdictional assessment.Facts; legal provision; remedy requested ↗Complaints under administered laws ↗ · Sources consulted:

How to distinguish it from other institutions

OCIF and OCS are different regulators. A cooperative’s name alone also does not identify the right forum: savings and credit cooperatives differ from other financial businesses. OCIF identifies COSSEC as the regulator to which that sector was transferred.Scope exclusions: insurance and savings and credit cooperatives ↗ · Sources consulted:

State supervision can coexist with another jurisdiction. The statute permits joint examinations and information sharing subject to confidentiality conditions; this does not make federal regulators OCIF subsidiaries or establish that every financial institution has the same deposit insurance.Art. 10(a)(15)–(18), (b) ↗Art. 10(a)(17)–(18), (b) ↗ · Sources consulted:

Legal basis

Act 4 of October 11, 1985 creates OCIF and defines its powers. Act 95-2009 removed its subordination to Hacienda and deemed inconsistent portions of Plan 3-1994 amended. Current article 5 makes the commissioner directly accountable to the governor. The Plan’s old list does not establish a present attachment.Arts. 2–5 ↗Art. 5(a) ↗Title; section 2 ↗Section 4: Plan 3-1994 ↗ · Sources consulted:

Leadership & appointments

Commissioner of Financial Institutions

The governor appoints the commissioner with Senate advice and consent. The Senate register records Mónica Rodríguez Villa’s nomination submission on July 1, 2025 and approval on September 8, 2025; the report of that session also records her confirmation. OCIF’s October 1, 2026 notice identifies her as commissioner. Senate submission does not establish the executive appointment date; that date and a term end remain unverified.Art. 5(a) ↗Header; notice date ↗Office row; submission, status, and last action ↗Plenary confirmation of executive nominations ↗ · Sources consulted:

Governance & composition

OCIF is headed by a commissioner. The Financial Board created within the office is a distinct body with rate and charge powers and advisory duties; it should not be mistaken for a corporate board replacing the commissioner’s leadership. Hacienda chairs that Board by statute, which does not restore OCIF’s former attachment to the department.Arts. 5, 8–10 ↗Arts. 8–9 ↗Art. 9 ↗Title; section 2 ↗Section 4: Plan 3-1994 ↗ · Sources consulted:

Judicial review depends on the statute and type of decision. For international financial entities, Act 273-2012 article 20 provides reconsideration and review by the Court of Appeals; a 2025 judgment applies that regime to a license-renewal denial. The old reference to the Court of First Instance and fifteen days in Act 4 article 15 is not generalized to every case.Art. 20 ↗Art. 20 ↗Judgment, pp. 1, 16–17; dissent begins on p. 21 ↗Art. 15 ↗ · Sources consulted:
